This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name www.kyrosdiamond.com ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned by KYROS Diamonds, a company incorporated under the Companies Act, 1956 with its registered office at 228, Shreeji Diamond, Mini Bazar, Varachha Road, Surat, Gujarat, 395006, India (hereinafter referred to as "Platform Owner", "we", "us", "our").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction.

By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, "Services").

For the purpose of these Terms of Use, wherever the context so requires "you", "your" or "user" shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws. All trademarks, logos, and service marks displayed on the Platform are the property of KYROS Diamonds or their respective owners.

5. Payments and Charges

You agree to pay us the charges associated with availing the Services. All prices displayed on the Platform are in Indian Rupees (INR) unless otherwise specified. We reserve the right to modify the prices of our products and services at any time without prior notice. Any applicable taxes, shipping charges, or other fees will be clearly indicated during the checkout process.

6. Prohibited Activities

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you. This includes, but is not limited to, engaging in any activity that could damage, disable, overburden, or impair the Platform, or interfere with any other party's use of the Platform.

You also agree not to attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks connected to the Platform, through hacking, password mining, or any other means. Any violation of these terms may result in immediate termination of your access to the Platform and legal action.

7. Third Party Links

You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. 8. Legal Contract

You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services. All orders placed on the Platform are subject to acceptance by us, and we reserve the right to refuse or cancel any order for any reason.

9. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

10. Limitation of Liability

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less.

11. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event. Force majeure events include, but are not limited to, acts of God, war, terrorism, strikes, natural disasters, governmental actions, or any other event beyond the reasonable control of either party.

All products sold on Kyros Diamond are made as per the specifications mentioned in the product listing. We strive to provide accurate and detailed descriptions of our products, including materials, dimensions, and certifications. However, slight variations in color, size, and appearance may occur due to screen settings and handcrafted production. Each piece of jewelry is crafted with care and may have unique characteristics that make it special.

2. Product Images

Product images are for reference only. Slight variations in color, size, and appearance may occur due to screen settings and handcrafted production. We make every effort to display the colors and details of our products as accurately as possible, but we cannot guarantee that your screen's display will exactly reflect the actual product.

3. Customized and Personalized Orders

Customized and personalized orders cannot be cancelled or returned once production has started. This includes any items that are made to your specific requirements, engraved, or modified from our standard offerings. We invest significant time and resources in creating custom pieces, and once production begins, we cannot resell or reuse the materials for another customer.

We strongly recommend that you carefully review all details of your custom order before confirming, as we are unable to make changes once production has commenced. Our team is available to assist you in the design process to ensure that your vision is accurately captured.

4. Order Processing and Shipping

Orders will be processed and shipped within the timeframe mentioned on the product page. Made-to-order and customized jewelry may require additional production time before shipment. We strive to meet all estimated delivery dates, but occasionally delays may occur due to factors beyond our control, such as customs clearance, weather conditions, or courier service interruptions.

We will provide you with tracking information once your order has been dispatched, allowing you to monitor the progress of your shipment. If you have any concerns about the status of your order, please do not hesitate to contact our customer support team.

5. Shipping Information

Customers are responsible for providing accurate shipping information. We are not responsible for orders delivered to incorrect addresses provided by the customer. If a package is returned due to an incorrect address or failed delivery attempts, reshipping charges may apply. Please double-check your shipping address before confirming your order.

2. Governing Law and Jurisdiction

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.

By using the Platform, you agree to submit to the jurisdiction of the courts in Surat, Gujarat, and waive any objection to the exercise of jurisdiction over you by such courts and to the venue of such courts.

3. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original provision.

4. Waiver

Our failure to enforce any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by an authorized representative of KYROS Diamonds.

5. Entire Agreement

These Terms of Use, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and KYROS Diamonds regarding your use of the Platform and supersede all prior agreements and understandings, whether written or oral.
